Terms of service

1. Acceptance of the terms

These terms are a binding agreement between MsPinaySmm (https://panelos-pinay.c-dl.com) and any person or company that uses the site, its API or buys its services. Creating an account or placing an order means you accept them in full. If the language versions differ, the English version prevails.

2. Changes to the terms

We may change these terms at any time. A change applies as soon as it is published on this page. Please read them before each order: using the service after a change means you accept the new version.

3. The services

MsPinaySmm sells digital services, mainly social media marketing ("the Services"). Service descriptions are for information and can change. We do our best to deliver what is described, but results can vary because of technical limits, the social networks or our suppliers.

4. Rules of the social networks

You must follow the rules of the platforms you order for (Instagram, Facebook, TikTok, YouTube, X, Spotify and others). We are not responsible for a suspension, ban, restriction or removal caused by a breach of those rules.

5. Prices and payment

Prices can change at any time without notice. The price shown when you place an order is the one you pay; later changes do not affect it. Orders are paid in full from your balance before they start.

6. Delivery time

Start times and speeds are estimates, not promises. Delays can come from demand, technical problems or changes on the platforms. An order in progress is not refunded because it seems slow.

7. No guarantee of results

Unless a service clearly says otherwise, we do not guarantee any result: engagement, retention, reach or sales. We provide the Services with our best efforts, not with an obligation of result.

8. Changes to a service

To complete an order, we may change the delivery method, the supplier or the service used. This does not give a right to a refund when the delivered service serves the purpose of the order.

9. Refunds

All sales are final, except when an order cannot be delivered: the amount not delivered is then credited to your MsPinaySmm balance. There is no refund, reversal or cancel for:

  • orders in progress or completed;
  • delays, real or felt;
  • drops or removals after delivery (except during the refill period of services that offer one);
  • a wrong, incomplete or private link or username;
  • a breach of the platforms' rules.

Credits are only made to your MsPinaySmm balance, never to a bank account, card or external wallet, and one goodwill credit does not create a right for later orders. Opening a dispute or chargeback without contacting support first breaks these terms and can lead to the suspension of the account.

10. Your responsibility

You are the only one responsible for the information you give: usernames, links and keeping the account or post public until the order is complete. We are not responsible for an order that fails because of wrong or incomplete information.

11. Limitation of liability

MsPinaySmm is not liable for any direct or indirect damage, including loss of money, data or reputation, or penalties on your accounts. You use the Services at your own risk. In any case, our liability is limited to the amount paid for the order concerned.

12. Suspension and closing of accounts

We may suspend or close an account, without notice or compensation, in case of:

  • breach of these terms;
  • fraud, chargeback or payment dispute;
  • abuse, unauthorized resale or attempts to manipulate the system;
  • illegal or improper use;
  • any action that harms our service, our suppliers or our reputation.

The balance and the orders of a suspended account can be frozen or canceled without refund.

13. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control: network outages, failures of the platforms, natural disasters, government decisions or any other case of force majeure.

14. Governing law

These terms are governed by the law that applies where MsPinaySmm is run. Any dispute goes to the competent courts of that place.

16. Social media specifics

The platforms' algorithms, rules and controls are outside our control. We do not guarantee the safety of an account, how long results last, or protection against bans, shadow bans, removals or restrictions. A loss after delivery is not a reason for a refund or a dispute, outside the refill conditions of the service.

17. API and resale

If you use our API or resell our Services, you are fully responsible for your own clients and must make sure they follow these terms. We are not part of disputes between you and your clients. We may change or replace services, suppliers or delivery methods to complete orders.

18. Chargebacks and payment disputes

Chargebacks, payment reversals and disputes opened without contacting us are forbidden. A chargeback leads to the immediate suspension of the account and a permanent ban. We may give the payment provider the transaction details, logs, IP addresses and order history to answer the dispute. Recovery fees may be added.

19. Cryptocurrency and wallet payments

Payments in cryptocurrency or with a digital wallet cannot be reversed and are never refunded. You are responsible for the address, the network and the details of your transfer. We are not responsible for a loss caused by a wrong or incompatible transfer. A slow blockchain confirmation is not a reason to cancel or refund.
